MEDICAL POWERS OF ATTORNEY should be treated with the greatest
of caution.
They can be appropriate in certain circumstances but they have
some serious draw-backs for the majority of cases.
Those “draw-backs” do not occur when one has an
Enduring Power of Attorney and an Enduring Power of Guardian
.
Under an Enduring Power of Guardian there is a power not otherwise
satisfactorily included in the MPA.
Speak to your solicitor to find out more if you wish to explore
MEDICAL POWERS OF ATTORNEY.
The Medical Power of Attorney takes priority over persons appointed
under Enduring Powers of Guardian, and would “cut out”
all (adult) children being joint and several and equal.
You must decide upon an order of priority of acting and you
would have to have legal advice
before you should accept that situation.
